Changes to Account and Benefits Terms: We reserve the right to change the APR and other account terms in accordance with the Cardmember Agreement, Delaware law and the Federal Truth in Lending Act. We also reserve the right to change the benefits and features associated with the card or the account.

About Your Credit Report and Your Credit Performance: You agree that Barclays has the right to obtain a current credit report in connection with our review of your application and, subsequently, in connection with a requested charge to any account with us, the renewal of your account, or a change in your credit line; and that we have the right to report to others our credit experience with you. Upon your request, we will tell you the name and address of each consumer reporting agency from which we obtained a consumer report about you. After your account is opened, we will periodically review your credit performance. If you do not maintain your credit performance, we may change your account terms.

How the Variable APRs on Your Account will be Determined: The APRs on your account will be determined each billing cycle by adding a margin to the Prime Rate (which will be the highest rate published in the Money Rates column of The Wall Street Journal on the last business day of each month). See your Cardmember Agreement for more detail. The APRs noted above are current as of 01/30/2014 using a Prime Rate of 3.25%.

Important Information About Procedures for Opening a New Account: To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means to you: When you apply for an account, we will ask for your name, street address, date of birth, social security number, and other information that will allow us to identify you. We may also ask to see copies of identifying documents. We also ask for your country of citizenship.

Notice to Married Wisconsin Residents: No provision of any marital property agreement, unilateral statement under Section 766.59 of the Wisconsin statutes, or court order under Section 766.70 adversely affects the interest of the creditor, Barclays Bank Delaware, unless the Bank, prior to the time the credit is granted or an open-end credit plan is entered into, is furnished a copy of the Agreement, Statement or Decree, or has actual knowledge of the adverse provision. IF I AM A MARRIED WISCONSIN RESIDENT, CREDIT EXTENDED UNDER THIS ACCOUNT WILL BE INCURRED IN THE INTEREST OF MY MARRIAGE OR FAMILY.

Your Telephone Number: By providing us with a telephone number(s), at the time you apply or anytime thereafter, you authorize Barclays and its affiliates, agents and independent contractors, to contact you regarding your account at such number using any means of communication, including, but not limited to calls placed to your cell, mobile or other phone using an automated dialing service, pre-recorded messages or text messages. Standard text messaging and/or calling charges may apply.

Balance Transfers. Here's How it Works:
To request a balance transfer please enter the 15/16 digit account number from the MasterCard, Visa, American Express, or Discover Card account that you want us to process a balance transfer to. If the total amount you request exceeds the assigned credit line on your new account, we may either decline the request or send a partial payment to your creditor(s).  The amount of available credit on your new account will be reduced by the amount transferred and the related balance transfer fees.  We reserve the right to decline to process any requested balance transfer.  We will not process a request to transfer a balance from any other account you may have with us. Balance transfers incur interest from the transaction date. You should not transfer the amount of any disputed purchase or other charge. If you do, you may lose your dispute rights.  Upon approval of your application we will process the requested balance transfer payment to the account(s) which you have requested on the 10th day after we’ve mailed you your card; during this 10 day time period you may cancel your balance transfer by contacting us at the number on the back of your card.

A balance transfer may take up to 4 weeks to post to your other credit card accounts. Continue to pay each creditor until the balance transfer appears on the other account as a credit. If you would like to complete a balance transfer from another account that is not a Visa, MasterCard, American Express, or Discover card, please call the phone number on the back of your new credit card once you are approved. Balance transfers are subject to availability. We may deny balance transfer requests at any time and for any reason.

Paying Interest on Balance Transfers and Cash Advances:
We charge interest on balances transfers and cash advances beginning on the transaction date. We charge interest on purchases unless you pay your entire balance, which includes all purchases, cash advances and balance transfers by the payment due date each and every month. Your entire balance includes any balances you transfer pursuant to this offer. This means that we will charge you interest on purchases if you do not pay any balance transfers in full by the first payment due date. Please see your Cardmember Agreement for details on how interest accrues.

Cash Equivalent Purchases: The purchase of money orders, travelers' checks, foreign currency, lottery tickets, gambling chips, wire transfers and other similar transactions are treated as cash advances. Please see the Cardmember Agreement that will accompany your credit card upon account opening for more details.

The information contained in these disclosures is accurate as of 01/30/2014 and may change after this date.

Information Sharing:
Barclays' Privacy Policy is available online at www.BarclaycardUS.com. I agree that Barclays Bank Delaware and Virgin America may share information about me and my Account to the extent needed to administer the Virgin America Visa Card in conjunction with the Virgin America Loyalty Program.

Virgin America Elevate Loyalty Program

a) When you applied for the Virgin America Credit Card Account issued by Barclays Bank Delaware ("Barclays"), you were asked whether the Primary Cardmember was a member of the Virgin America Loyalty Program ("Elevate"). If you answered yes and gave us the Primary Cardmember's Elevate membership number, then we will not issue a different membership number to you. If you answered no or did not give us the membership number, then we will issue the Primary Cardmember a membership number and ask Virgin America to enroll the Primary Cardmember into Elevate. Only one Elevate membership will be established regardless of whether your Account is an individual account or an account with an authorized user. If the Account has an authorized user, then we will enroll the Primary Cardmember.  The Primary Cardmember can be eligible to receive and redeem "Elevate points" subject to the terms and conditions of the Elevate as established, modified, supplemented and/or amended by Virgin America from time to time (the "Elevate Terms and Conditions"). Please visit www.virginamerica.com/elevatememberguide for complete Elevate Terms and Conditions.

b) On the closing date of each billing cycle that your Account remains open and current, we will report to Virgin America the Net Purchases charged to your Account during a billing cycle and request that Virgin America award Elevate points as set forth in paragraph (d). If your Account is not open, current or in good standing on the date a billing cycle closes, then we will report no Net Purchases to Virgin America for that billing cycle. We will ask that Elevate points be awarded to the Primary Cardmember, regardless of who made the "Purchase." "Net Purchases" for a billing cycle are determined by totaling all new Purchases added to the Account during the billing cycle, and then subtracting credits posted to the Account during the period for returned Purchases and/or adjustments. For purposes of reporting Net Purchases, for each transaction, we may round up or down to whole dollar amounts. If credits for returned Purchases exceed new Purchases during a billing cycle, we will report negative Net Purchases and ask Virgin America to reduce the Primary Cardmember's accrued Elevate points accordingly. Point accumulation is subject to certain limitations, exclusions and restrictions. There is no limit to the number of Elevate points which may be earned. Net Purchases do not include fees, charges, credit insurance premiums, or transactions posting as Cash Advances or non-qualifying Balance Transfers, whether received from financial institutions, automated teller machines, by use of Barclays, checks, or by any other means. We reserve the right to exclude from Net Purchases unauthorized Purchases, Purchases which are added to your Account after you are past due or over your credit line. We may ask Virgin America to withdraw Elevate points previously awarded if your Account is more than sixty (60) days past due, or if the points were awarded on Purchases not authorized by you. We are not responsible to award Elevate points under the Program, to arrange or provide for any services related to travel or the use of Elevate points, for any delay, failure, or refusal by Virgin America to award or redeem Elevate points, or for any decision by Virgin America to revoke or cancel points or membership in the Program.

Effective on September 10, 2010, to continue to participate in the rewards program, your account must remain open and in good standing, you must maintain your creditworthiness and you must use your card for at least one (1) purchase transaction every six (6) months (or have some type of account balance every six months).  Failure to meet these requirements may result in account closure and forfeiture of all outstanding points earned.  In addition, if your payment is late in a particular billing cycle, this may result in the forfeiture of points earned in that billing cycle.  If your points are forfeited for any reason, we will not reinstate these points to your account.

c) We will show on your monthly Account statement the Primary Cardmember's monthly accrued Elevate points as reflected in our records. You understand that there will be a delay between the date you make a Purchase, the date we report Net Purchases to Virgin America, and the date that Virgin America acts upon the information, and that, for this and other reasons, our records and the records of Virgin America regarding the Primary Cardmember's accrued points may differ. You understand and agree that Elevate points are not received by the Primary Cardmember until awarded by Virgin America, and that, in the event of any discrepancy between our records and Virgin America’s records of the Primary Cardmember's accrued points, then the records of Virgin America will stand.

d) Virgin America Visa Signature and Platinum credit card Cardmembers with $49 Annual Fee will earn three (3) Elevate points for every one dollar ($1.00) of net purchases of Virgin America tickets or RED in-flight purchases with the Account rounded to the nearest dollar; and one (1) Elevate point for every one dollar ($1.00) of Net Purchases made anywhere else with the Account rounded to the nearest dollar. The 10,000 bonus points will be awarded upon the first use of your Account for a purchase or balance transfer and have paid the Annual Fee on the account (and such fee is not rescinded).  Bonus points will be sent to Virgin America at the close of the first billing statement in which the purchase or balance transfer has posted. Virgin America credit card Cardmembers will earn one (1) Elevate point for every one dollar ($1.00) in balances transferred to your account during the first 30 days the account is open up to a maximum of 5,000 points.  Convenience Checks do not qualify for Elevate points. Cardmembers will also earn 300 bonus points for every $5,000 in net purchases per year, up to 1,200 annual bonus points.

As an Elevate member, your Elevate points will not expire as long as you have earning or redemption activity at least once every 18 months. So your points will extend for another 18 months with any qualifying activity such as flights on Virgin America, completed reward travel, or through earning points on your Virgin America credit card or other partners.

e) Qualifying Status Points.  Each year, Virgin America Visa cardholders will earn bonus status points if $25,000 in eligible purchases have been made using the credit card during the applicable year.  Cardmembers that have an annual fee will earn 10,000 status points (provided the annual fee has been paid) and Cardmembers not paying an annual fee will earn 5,000 status points. Each year will be measured based on billing cycle end dates beginning in January and ending in December of the applicable year, regardless of account open date. Any eligible purchases made after the December billing cycle end date will be applied to toward the next year’s status point earnings. Approximately 6-8 weeks after the billing cycle end date in which the $25,000 in eligible purchases threshold has been reached, the 10,000 or 5,000 Status Points earned, as applicable, will be posted to the cardholder’s Elevate account.  Offer applies to primary cardholder only and the status points may be earned only once per year.  Eligible purchases include purchases made with the card and do not include bonus points, returned goods and services, cash advances, convenience checks, transferred balances, credits, fees and interest charges. Please log in to your Elevate account page on Virginamerica.com to view your year to date status points. Should the posting of the additional status points result in your qualifying or requalifying for Elevate Silver or Elevate Gold status, your status will be valid throughout the subsequent membership benefit year. All Elevate program terms and conditions apply. Status points only count toward status qualification and cannot be redeemed for reward travel. Benefits associated with any new status level will take effect within 5 business days after status points were posted to your Elevate account.  Requirements for Elevate Status Benefits are available on Virginamerica.com. This promotion may be discontinued at any time or the terms of such promotion changed, without notice to you. To review the complete Terms and Conditions, please visit virginamerica.com/memberguide.
